1. Who we are

The Leverage service ("Service") is provided by Levu Inc. ("Levu", "we", "us"). By using the Service you are entering into an agreement with Levu Inc.

2. Acceptance of terms

By creating an account, accessing, or continuing to use the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization. If you are using it as an individual, you confirm you are of legal age in your jurisdiction.

3. The Service

Leverage is an AI-powered CRM, dispatch, and customer-communications platform for contractors and service businesses. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with your selected plan.

4. Account & accuracy

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and keep it up to date.

5. Acceptable use

You must not misuse the Service. In particular, you must not:

• Use the Service for any unlawful purpose or in violation of any law;
• Engage in fraud, spam, or deceptive practices;
• Infringe the intellectual property or privacy rights of others;
• Interfere with or compromise the security or integrity of the Service (e.g. malware, probing, scraping, reverse engineering, or circumventing technical limits);
• Resell or redistribute the Service without our written consent.

6. Intellectual property

Levu Inc. retains all right, title, and interest in and to the Service, including all software, documentation, branding, and related intellectual property. No rights are granted to you except as expressly set forth in these Terms.

7. User content

You retain ownership of the content you upload or generate in the Service. You grant Levu a limited license to host, store, and process your content solely to provide and improve the Service.

8. Payments, billing, and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms and our Refund Policy.

9. Service level

We work hard to keep the Service available, but we do not guarantee uninterrupted or error-free performance. The Service is provided "as is" and, to the fullest extent permitted by law, we disclaim all implied warranties including merchantability and fitness for a particular purpose.

10. Limitation of liability

To the maximum extent permitted by law, Levu's aggregate liability arising out of or relating to the Service is capped at the fees paid by you in the twelve (12) months preceding the claim. We are not liable for indirect, consequential, special, incidental, or punitive damages, including loss of profits, data, or goodwill. Nothing limits liability for fraud, death, or personal injury where such limitation is not permitted by law.

11. Indemnity

You agree to indemnify and hold Levu harmless from claims arising out of your content, your use of the Service in violation of these Terms, or your unlawful conduct.

12. Suspension and termination

We may suspend or terminate your access to the Service for: material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, your right to use the Service ends; you may export your data within a reasonable period after which it may be deleted.

13. AI features

The Service includes AI-powered features (e.g. follow-ups, summarization). You are responsible for your prompts and how you use AI outputs, including verifying accuracy and ensuring you have the rights to any input content. Outputs may be inaccurate and should not be relied upon for regulated professional advice without human oversight. We may filter, restrict, or refuse outputs and may suspend accounts for misuse (e.g. illegal content, deepfakes, hate speech, malware, jailbreaking).

14. Governing law

These Terms are governed by the laws of the jurisdiction in which Levu Inc. is incorporated, without regard to conflict of laws principles. Disputes will be resolved in the competent courts of that jurisdiction.

15. Assignment & force majeure

You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays or failures caused by events beyond reasonable control.

16. Changes

We may update these Terms from time to time. Material changes will be communicated via the Service or by email. Continued use after changes constitutes acceptance.
